DAMAGE, LOSS & LIABILITY POLICY
This policy explains how Locurator handles artwork that is damaged, lost, or stolen while part of the Locurator network.
1. Nature of Public Display
Artists acknowledge that artworks placed through Locurator are displayed in public or semi-public commercial spaces, including cafés, hotels, clinics, offices, and similar venues.
Because of this:
- Normal wear
- Minor handling marks
- Light environmental exposure
are expected and do not constitute damage.
2. Responsibility Framework
While an artwork is in the Locurator network, responsibility is divided as follows:

Each party is responsible only for what happens while the artwork is under their control.
3. What Counts as Damage
Covered damage includes:
- Breakage
- Tears or punctures
- Severe scratches
- Structural damage
- Water or heat damage
- Theft or disappearance
Not covered:
- Minor scuffs
- Fading from light
- Small fame wear
- Dust or surface grime
4. Damage Reporting
If damage occurs:
- The venue must notify Locurator within 48 hours
- Locurator will photograph and document the damage
- The artist will be notified within 5 business days
5. Compensation Rules
If damage is caused by:
- A Locurator staff member
- A Locurator transport contractor
- A venue's negligence
Locurator will compensate the artist up to:
The artist’s net commission amount (65%) of the listed retail price
Example:
Artwork price: $1000
Artist share: $650
Maximum compensation: $650
This reflects that unsold art has no realized market value yet.
6. Partial Damage
If the artwork is damaged but still sellable:
- Locurator may request a new price
- Artist may approve or decline price changes
- If sold at a discount, artist and commissions adjust proportionally
7. Total Loss or Theft
If an artwork is lost or stolen while under Locurator or venue responsibility:
- Locurator will compensate the artist based on Section 5.
- Ownership of the lost piece transfers to Locurator
8. Insurance
Locurator does not provide fine art insurance. Works are protected by a reserve fund against theft or total loss.
Artists are encouraged to insure high-value works independently.
9. Limitation of Liability
Locurator is not responsible for:
- Natural disasters
- Fire
- Flood
- Civil unrest
- Building-wide incidents
