BUYER TERMS & CONDITIONS
By purchasing artwork through Locurator, you agree to the following:
1. Nature of the Sale
Locurator acts solely as a sales agent for independent artists.
The legal seller is the artist. Locurator facilitates payment, listing, and logistics coordination.
2. Artwork Representation
All artwork is represented by the artist.
Images, descriptions, and dimensions are provided in good faith. Minor differences in color or framing due to lighting or display are normal.
3. Pricing
All prices are set by the artist.
Locurator may recommend pricing changes, but final pricing belongs to the artist.
4. Payment Processing
Locurator processes payment on behalf of the artist.
Funds are held until the transaction is confirmed.
5. Taxes
Sales tax is charged only when legally required based on the artist’s registration status.
Locurator will display any applicable taxes at checkout.
6. Delivery & Shipping
After purchase:
- Locurator coordinates release of the artwork
- The artwork is packed and shipped or made available for pickup
Shipping costs are paid by the buyer unless otherwise stated.
7. Transfer of Risk
Once the artwork is:
- Picked up by the carrier, or
- Collected by the user
All risk transfers to the buyer.
This includes:
- Loss
- Theft
- Damage
- Delay
Locurator and the artist are not responsible once the artwork leaves their possession.
8. Shipping Insurance
Buyers are strongly encouraged to purchase shipping insurance through the carrier.
If no insurance is purchased:
- The buyer assumes full financial risk
- No refunds or replacements will be issued for shipping damage or loss
9. Returns & Refunds
All artwork sales are final.
Refunds are only issued if:
- The wrong artwork was sent
- The artwork was materially misrepresented
Shipping damage is not refundable unless insured by the buyer.
10. Authenticity & Copyright
You receive ownership of the physical artwork only.
The artist retains all copyright and reproduction rights.
11. Venue Display
Artwork may have been displayed publicly before purchase.
Minor wear consistent with public display is normal and not considered damage.
12. Fraud & Abuse
Locurator may cancel transactions and block accounts for:
- Chargebacks
- Fraud
- Abusive behavior
13. Limitation of Liability
Locurator is not responsible for:
- Shipping issues
- Carrier delays
- Damage or loss in transit
- Buyer mishandling
14. Governing Law
All disputes are governed by the laws of the jurisdiction where Locurator operates.
