ARTIST TERMS OF SALE

These Terms govern the relationship between Locurator (“Platform”) and the Artist (“you”) regarding the display, marketing, and sale of artwork through Locurator’s venue network.

By submitting artwork to Locurator, you agree to the following:

1. Ownership & Rights

You remain the full copyright owner of all artwork you submit.

You grant Locurator a non-exclusive license to:

  • Display your artwork in participating venues
  • Photograph and digitally reproduce your artwork
  • Use images for marketing, listings, QR sales, and promotion
  • Sell the artwork on your behalf

2. Consignment Relationship

All artworks placed with Locurator are held on consignment.

This means:

  • You retain ownership
  • Locurator acts as your sales agent
  • No artwork is purchased by Locurator unless separately agreed

3. Pricing Authority

You propose a retail price for each piece.

Locurator may recommend pricing changes based on:

  • Market data
  • Venue type
  • Buyer behavior

Final pricing must be approved by you before placement.

Locurator may offer discounts or promotions only if authorized by you or clearly stated in your agreement.

4. Commissions & Payouts

Unless otherwise stated:

  • Artist: 65%
  • Venue: 10%
  • Locurator: 25%

All percentages are calculated from the final sale price.

Locurator collects payment, distributes commissions, and pays artists within 30 days of a completed sale.

5. Payment Processing

Locurator handles:

  • Buyer payment
  • Sales tracking
  • Tax collection (where applicable)
  • Payout distribution

Artists are responsible for their own income taxes.

6. Artwork Handling & Risk

Locurator will take reasonable care of all artwork while in its possession or placed at venues.

However:

  • Locurator is not an insurer
  • Normal wear from public display is expected
  • Artists accept the risk of minor handling damage

Loss or major damage will be handled according to Locurator's Damage Policy.

7. Reproduction & Prints

You may sell:

  • Prints
  • Derivatives
  • Digital reproductions

Venues never receive copyright or print rights — they only host the physical artwork.

8. Removal & Withdrawal

You may request removal of your artwork with 30 days notice.

Locurator may remove any piece at any time for:

  • Venue fit
  • Safety
  • Quality
  • Buyer complaints

Artwork will be returned or held for pickup within a reasonable time.

9. Exclusivity

You may not list the same physical piece for sale simultaneously at another gallery or platform while it is placed through Locurator.

You may list different pieces elsewhere.

10. Marketing & Promotion

You allow Locurator to:

  • Feature your art
  • Use your name and bio
  • Promote sales and venues

You may also promote your Locurator listings.

11. Termination

Locurator may suspend or terminate accounts for:

  • Misrepresentation
  • Copyright violations
  • Fraud
  • Abusive content

Any sold artwork remains payable.

12. Dispute Resolution

Any disputes will first be handled by good-faith negotiation.

If unresolved, disputes will be governed by the laws of the jurisdiction Locurator operates in.
